Welcome to this website, a service of the PR State Office of Energy Policy (collectively, the “Administration,” “we,” or “us”). Please read this Visitor Agreement (this “Agreement”) before you use this website. By using this website, you agree to abide by the terms of this Agreement. We may change the terms of this Agreement from time to time without prior notice. By continuing to use the website or the incentives granted by the Administration, after we post any changes, you accept and agree to this Agreement, as modified.

Privacy

Pursuant to Act 83 of July 19, 2010, otherwise known as the “Puerto Rico Green Energy Incentives Act”, the Administration is granted the authority to manage the Puerto Rico Green Energy Fund (“GEF”). What follows is the Administration’s online privacy policy for this website and the GEF’s online application system. This policy governs personal information gathered during the application, evaluation, award, and disbursement process for renewable energy incentives under the GEF. To make use of some features on this website visitors and users need to provide certain information. We may ask, for example, for your name, social security number (SSN), e-mail address, street address, zip code, and financial account information. We will also request other information in order to process an application. Our systems may remember some of this information the next time you log in and use our website. Some of the information submitted may be shared with, stored and maintained by third party contractors not related to the Administration. By using this website and applying for an incentive, you consent to such sharing, storage and keeping. If we request your SSN, we will use it to adequately identify you and sending your information to the Puerto Rico Department of the Treasury. The information you furnish on this form, including your SSN is voluntary. However, failure to provide the requested information may prevent us from providing the benefits you seek. The Administration shall not be responsible for misuse of a SSN provided by owners to third parties to complete the application to our programs. Providing a SSN to a third party applicant shall be sole responsibility and prerogative of the SSN holder. SSN holder/owner may directly incorporate his or her number during the application process. Furthermore, if you are providing the Social Security Number on behalf of someone else, you must be ready to provide evidence that shows your authority to sign the application as well as documents to prove your identity and the identity of the person for whom you are filing the application. We can only accept original documents or documents certified by the custodian of the original record. Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of personal information. All Administration staff and contractors, who may see your personal information in the course of performing their duties, will be required to use that personal information solely in accordance with the terms of this privacy statement. However, as effective as any security measure implemented by the Administration and its authorized contractors and vendors may be, no security system is impenetrable. We cannot guarantee the complete security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to us over the Internet. This website is not directed to users under the age of 18 and no one under the age of 18 should use the website. The Administration does not knowingly collect personally identifiable information from anyone under the age of 18 on this website unless expressly specified on the appropriate pages of the website. The Administration will not sell or lease your personal information to third parties without your permission. Unless you otherwise consent, and except as provided below, we will use your personal information only to administer the GEF program and enable your access to and use of this website. Personal information will also be used to communicate with you, handle requests for information, and process incentive requests, and we will use such information to provide operational notices, in program record-keeping and to conduct research on industry marketplace practices. Our research may lead to the publication of aggregate demographical and renewable energy technology data.

The Administration may release personal information under the following circumstances:

  • When release is required by law or regulation, or is requested by a local or federal law enforcement or other government agency;
  • When our records indicate that an user may be engaged in a fraudulent activity or other deceptive practices that a law enforcement or other governmental agency should be made aware of;
  • To appropriate agencies, departments, and public corporations of the Government of Puerto Rico for audit or operational purposes; in such cases, only the information requested to complete the specific task will be disclosed;

Our Web sites are not set up to track, collect or distribute personal information not entered by visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information. A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer's hard drive. The GEF Website uses non-identifying cookies to provide easier site navigation and access to forms. Our cookies do not generate personal data, do not read personal data from your machine, and are never tied to anything that could be used to identify you. We may change this privacy statement from time to time. If we change this privacy statement at some point in the future, we’ll post the changes on our website and by continuing to use the website after we post any changes, you accept and agree to this privacy statement, as modified.

Submissions and Postings; Disclosure

You are solely responsible for any information that you submit or post on this website. By using this website you agree not to submit, post or transmit any defamatory, abusive, obscene, false, misleading, threatening or illegal information or material, or any other material that infringes on the ability of others to enjoy this website or that infringes on the rights of others. We retain the right to deny access to anyone who we believe has violated these terms or any other term of this Agreement. We reserve the right (but assume no obligation) to monitor, delete, move, or edit any submissions or postings that come to our attention that we consider unacceptable or inappropriate, whether for legal or other reasons. We will comply with all requirements of law regarding disclosure of any submissions or postings on this website to others, including to law enforcement agencies and parties making civil legal requests. We will also comply with any other requirements of the law regarding disclosure of other aspects of your use of this website.

Termination

The Administration reserves the right at any time to terminate your use of this website if you fail to comply in full with any term of this Agreement, or any other terms, agreements, or policies that apply to this website and the use of it.

Indemnification

You agree to indemnify, defend, and hold harmless the Administration (including its parents, subsidiaries and affiliates and all of their respective officers, directors, employees, agents, licensors, suppliers, and any third-party information providers) against all claims, losses, expenses, damages and costs (including reasonable attorney fees) resulting from any breach of this Agreement or unauthorized use of this website, or by the submission of false information. Your indemnification obligation shall survive the termination of this Agreement. At our expense and election, we reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you and you agree to cooperate with the Administration in connection with our defense.

Disclaimer of Warranties and Liability

YOU AGREE THAT YOUR USE OF THIS WEBSITE IS AT YOUR SOLE RISK. Miscellaneous

To obtain access to certain services on our website, you may be required to register. As part of any such registration process, you will select a user name and a password. You agree that the information you supply during that registration process will be accurate and complete and that you will not register under the name of, nor attempt to enter the service under the name of, another person. The Administration reserves the right to reject or terminate any user name that, in its judgment, it deems offensive. You will be responsible for preserving the confidentiality of your password and will notify us of any known or suspected unauthorized use of your account. This Agreement has been made in and shall be construed in accordance with the laws of the Commonwealth of Puerto Rico. By using this website, you consent to the exclusive jurisdiction of the state courts of the Commonwealth of Puerto Rico, San Juan Part, in all disputes arising out of or relating to this Agreement or this website. In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect.
